Swedish Government's Natura 2000 decision on Gotland maintained by the Supreme Administrative Court
The Swedish Supreme Administrative Court has announced today that it will not repeal the government’s decision from 31 August 2015 to designate Nordkalk’s planned limestone quarry Bunge on Northern Gotland as a new Natura 2000 site.
- We are surprised by the court’s decision. Nordkalk has since earlier a decision on permission that has gained legal force in 2010. The Land and Environment Court granted Nordkalk a permit including conditions in 2014 and the permit process has continued for more than 11 years, says Hannu Hautala, Chief Executive Officer of Nordkalk Corporation.
- Since the Supreme Administrative Court did not find that the Natura 2000 decision would infringe upon Nordkalk’s right to a fair trial, Nordkalk will further analyze the judgement of the court in order to evaluate whether there is a possibility to bring this case to the European Court of Human Rights, concludes Hautala.
Nordkalk is now going to analyze today’s judgement thoroughly before the next steps are decided upon. What the effects are on the ongoing permit process in the Land and Environment Court of Appeal remains to be addressed later.
